These Terms of Service ("Terms") govern your use of the Appy Days application and website (collectively, the "Service") operated by Appy Days ("we," "us," or "our"). By using the Service, you agree to these Terms.

1. Acceptance of Terms

By installing our Shopify app or accessing our website, you agree to be bound by these Terms. If you do not agree, you must not use the Service. We may update these Terms at any time, and continued use constitutes acceptance of the revised Terms.

2. Description of Service

Appy Days provides a suite of e-commerce tools for Shopify stores, including product reviews, upsell and cross-sell features, popups, SEO optimization, and a free shipping bar. The Service is provided through the Shopify App Store and operates within the Shopify platform.

3. Account and Store Access

  • You must have an active Shopify store to use the Service
  • You are responsible for maintaining the security of your Shopify account
  • You must provide accurate and complete information during installation
  • You are responsible for all activity that occurs under your account

4. User Obligations

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or servers
  • Use the Service to transmit spam, malware, or harmful content
  • Violate any applicable laws or Shopify's terms of service
  • Resell or redistribute the Service without written permission

5. Billing and Payments

Paid plans are billed through the Shopify billing system. By selecting a paid plan, you authorize Shopify to charge your account the applicable subscription fees. All fees are in US dollars unless otherwise stated. Prices may change with 30 days' notice.

6. Intellectual Property

The Service, including all code, designs, content, and trademarks, is owned by Appy Days. You retain ownership of your store data, reviews, and content. By using the Service, you grant us a limited license to process your data as necessary to provide the Service.

7. Limitation of Liability

To the maximum extent permitted by law, Appy Days shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

9. Termination

You may terminate your use of the Service at any time by uninstalling the app from your Shopify store. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your data will be deleted within 30 days in accordance with our Privacy Policy.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.
